Terms & Conditions — MCM Design & Renovate

These Terms & Conditions (“Terms”) govern your use of the MCM Design & Renovate website and your relationship with MCM Design & Renovate (“we”, “us”, “our”). By visiting our website, contacting us, requesting a quote, or entering into a contract for services, you accept and agree to these Terms.
1. Services
We provide design, remodeling, cabinetry, flooring (including granite), roofing, and related renovation services (the “Services”). Specific scope, deliverables, timelines, and pricing will be set out in a written estimate, proposal, or contract signed by both parties.
2. Estimates, Contracts & Acceptance
All estimates are valid for the period specified in the estimate (usually 30 days) unless stated otherwise.
A written contract or signed estimate is required to start work. Contracts govern scope, payment schedule, change order procedures, and warranties.
Any verbal agreements must be confirmed in writing to be binding.
3. Payment Terms
A deposit is required to schedule and begin work. Deposit amount will be stated in your contract or estimate.
Progress payments may be required as work proceeds. Final payment is due upon completion and before final turnover unless otherwise agreed in writing.
Payments not made when due may incur late fees and may result in work stoppage.
We accept payments as stated in the contract (credit card, check, bank transfer, or third-party processors).
4. Change Orders
Any work beyond the written scope requires a written change order signed by both parties.
Change orders may affect price, completion date, and other project terms.
5. Client Responsibilities
You agree to:
Provide access to the property during agreed hours.
Obtain necessary permissions or approvals if you are not the property owner.
Provide accurate information about existing conditions and utilities.
Remove personal items and protect valuables prior to work commencement.
Notify us of any design preferences, restrictions, or special conditions.
6. Scheduling & Delays
Project timelines are estimates and may change due to weather, material availability, permitting delays, subcontractor scheduling, or other causes beyond our control.
We will communicate delays and reasonable revised timelines.
7. Permits & Code Compliance
Unless otherwise agreed, we will assist in obtaining required permits and ensure work complies with applicable codes. Permit fees are the client’s responsibility unless included in the contract.
8. Warranties
We warrant that workmanship performed directly by MCM Design & Renovate will be free from material defects for a period of one (1) year from substantial completion, unless a different warranty period is specified in your contract. This warranty does not cover normal wear and tear, damage from misuse, acts of God, or defects covered by manufacturers’ warranties.
Manufacturer warranties for products (appliances, fixtures, cabinetry hardware, countertops, etc.) are passed through to you where applicable.
9. Materials & Substitutions
We will use materials specified in your contract. If specified materials are unavailable, we will propose comparable substitutes and obtain your approval (documented in writing).
Color, grain, and pattern variations are inherent in natural materials and are not defects.
10. Site Conditions & Additional Costs
Unforeseen conditions (hidden structural issues, mold, asbestos, insect damage, concealed mechanical issues) may require additional work and cost. We will notify you and provide an estimate for approval before proceeding.
11. Insurance & Liability
We carry general liability insurance and workers’ compensation as required by law. Certificates may be provided upon request.
Limitation of Liability: Our total liability for any claim related to the Services shall not exceed the total amount you paid to us for the specific project giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages.
12. Indemnification
You agree to indemnify and hold us harmless from claims, damages, losses, and expenses (including attorneys’ fees) arising from your negligence, breach of contract, or unauthorized modifications.
13. Intellectual Property
All content on our website (text, images, logos, designs) is the property of MCM Design & Renovate or its licensors. You may not reproduce or use such content without our written permission. For project photography: by permitting us to photograph completed work or by submitting photos, you grant us a non-exclusive license to use images for marketing and portfolio purposes unless you request otherwise in writing.
14. Termination & Suspension
We may suspend or terminate work for nonpayment, breach of contract, or unsafe conditions.
If the contract is terminated by you without cause, you may be responsible for costs incurred, reasonable termination fees, and payment for work completed.
15. Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control (natural disasters, strikes, government actions, supply chain interruptions).
16. Dispute Resolution
Governing law: These Terms and any contract shall be governed by the laws of the State of Texas, without regard to conflict of law principles.
Venue: Any litigation will be brought in state or federal courts located in Bexar County, Texas, unless the parties agree to arbitration.
Arbitration (optional): Parties may agree in writing to resolve disputes by binding arbitration administered in Bexar County, Texas, under the rules of the chosen arbitration provider. Arbitration award may be entered in court.

18. Changes to Terms
We may update these Terms. Material changes will be posted with an updated effective date. Continued use of our Services after such changes constitutes acceptance.
19. Severability
If any provision is held invalid, the remainder of these Terms will continue in effect.
20. Entire Agreement
These Terms, together with any written contract, estimate, and change orders, constitute the entire agreement between you and MCM Design & Renovate regarding the Services.
